What is the 3% withholding when buying a property from a non-resident seller?

It’s the amount the buyer must withhold from the sale price and pay to the Spanish Tax Agency using Form 211, as a payment on account of the non-resident seller’s tax. If that withholding exceeds the actual tax owed, the seller can request a refund of the difference.

No. Organic Law 1/2025 abolished the residency-by-real-estate-investment scheme, with effect from 3 April 2025. Those who obtained it before that date keep the right to renew it; for new buyers, the current pathway is the non-lucrative residency visa or other alternatives depending on your profile.

In 2026, the main applicant must demonstrate around €28,800 a year in passive income or savings (400% of the IPREM), plus an additional amount for each family member included in the application.
