How long does it take to expunge a criminal record?

The time limit ranges from 6 months to 10 years depending on the severity of the sentence, and starts counting once the sentence is considered fully served, including any civil liability. Expungement is not automatic: it must be formally requested from the Ministry of Justice.

A criminal complaint (denuncia) is simply reporting a potentially criminal act, without needing to become a party to the proceedings. A private prosecution (querella) requires you to become the prosecuting party from the outset, with a lawyer and court agent (procurador), which gives you more control over the investigation.

It’s an abbreviated procedure for flagrant offences or those requiring simple investigation, such as certain drink-driving or theft cases, allowing the matter to be resolved within days. Because the procedure moves so quickly, having your lawyer act from the very first moment is especially decisive.
