Possessing drugs for personal use in a public place is punished with an administrative fine. It becomes a criminal offence if there are signs the drugs were meant for third parties, such as a quantity above normal personal consumption, cash, or items used to weigh and divide doses.
It depends on the substance. If it causes serious harm to health, such as cocaine or heroin, the sentence is 3 to 6 years in prison. For other substances, such as cannabis, it is 1 to 3 years. In minor cases the sentence can be reduced.
It is an aggravating circumstance that applies when the quantity seized is very large. Case law sets thresholds for each substance, and applying it means a longer prison sentence.
It depends on the quantity, the purpose and the circumstances. A small grow with no risk of supply to third parties may fall outside the criminal offence, although it still carries the risk of an administrative fine and an investigation.
